This Privacy Policy is global in nature and governs the Company’s websites (including www.ensembleschools.com, all subdomains, and all portals) (the “Website”), applications and other items that post a link to this Privacy Policy and applies to personally identifiable information from or about an individual (“Personal Information”) that we may collect from you.

Ensemble Schools provides lesson scheduling and asynchronous online teaching products through its various schools accessible through the Website. The Website and the teaching and sales offerings may be referred to collectively as “Services.”

Our schools are engaged in music and dance lessons, music and dance-related retail sales, instrument rental. We offer our Services to parents of music and dance studios, music and dance teachers and potential sellers of music and dance studios.

If you voluntarily provide your information in the course of interacting with our Website or otherwise using our Services, we will take that as your agreement to our collection, use, and disclosure of your information as set forth in this Privacy Policy.

Our dance and music lesson Services are only offered in the United States.

This Privacy Policy does not apply to any products, services, websites, or content that are offered by third parties (“Third Party Services”), which are governed by their respective privacy policies.

Residents of certain states in the United States may have additional rights and Ensemble Schools will update this policy as and when such laws become applicable to it.

Information You Provide to Us: The type of information you provide to us depends on the nature of your interaction with the Website and our Services.

FOR GENERAL VISITORS TO THE WEBSITE: In addition to information that you choose to submit to us, we and/or our service providers may automatically collect and/or store certain information when you visit or interact with the Website (“Usage Information”). This Usage Information may be stored and/or accessed from your personal computer, laptop, tablet, mobile phone or other device (a “Device”) whenever you visit or interact with our Site. Usage Information may include:

  • Your Device functionality (including browser, browser language, operating system, hardware, mobile network information).

(b) Information We Collect When You Interact with Third-Party Websites: The Services may include functionality that allows certain kinds of interactions between the Website and your account on a third-party website or application. The use of this functionality may involve the third-party site providing information to us. For example, lesson scheduling and asynchronous online teaching products are provided through third party software. These third parties may retain any information used or provided in any such communications or activities and these third parties’ practices are not subject to our Privacy Policy. We may not control or have access to your communications through these third parties. Further, when you use third-party sites or services, you are using their services and not our services and they, not we, are responsible for their practices. You should read the applicable third-party privacy policies before using such third-party tools on our Website.

(c) Information from Third Parties: Ensemble Schools also receives information from third parties. For example, a trade show may produce a list of attendees, and Ensemble Schools will use the list to communicate with the attendees. We may combine the information we collect from third parties with information that we have collected from you or through your use of the Services.

(d) Location data: We may obtain information about your location to provide customized Services, content, and other information that may be of interest to you. If you no longer wish for us or our service providers to collect and use location information, you may disable the location features on your Device. Consult your Device manufacturer settings for instructions. Please note that if you disable such features, your ability to access certain features, Services, content or products may be limited or disabled.

(e) Inferences: Using the other pieces of personal information collected about you, we may draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.

Marketing Information

(a) Surveys: From time to time, Ensemble Schools may invite you to participate in an online survey administered by Ensemble Schools or a third-party agent. In addition to questions about your experience with the Services, these surveys include Personal Information such as name and email and may request additional profile information. The results of these surveys help us better understand the needs of our customers in order to improve the Services and may be shared in aggregate format with third parties.

(b) Testimonials: We display personal testimonials of satisfied customers and dance instructors on our Website in addition to other endorsements. With your consent, we may post your testimonial along with your name, company, title, logo, or profile photo.

(c) Referrals: Ensemble Schools may invite you to participate in a referral program to inform your colleagues and friends about our Services. If you choose to use our referral service to tell a friend about our Services, we will ask you for your friend’s name and email address, which we understand you are authorized to provide.

Consent To Electronic Communications and Text Messages

By using the Services, you consent to receiving certain recurring electronic communications from us as further described in this Privacy Policy. You agree that any referrals, notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing. We may send text messages (including ‘SMS’ messages and messages through other messaging platforms) to you directly or via third-party providers in accordance with this Section.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency depends on your interaction. (a) To Third Parties Providing Services to Ensemble Schools. (b) To Protect the Rights of Ensemble Schools and Others. To the fullest extent permitted by applicable law, we may also disclose your information when required to by law or if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety or property of Ensemble Schools, its affiliates, third parties or the general public; or (ii) to respond to claims that any content violates the rights of a third party. This includes exchanging information with other companies and organizations for fraud prevention, spam/malware protection, and other similar purposes. To the fullest extent permitted by applicable law, we have complete discretion in electing to make or not make such disclosures, and to contest or not contest any requests for such disclosures, all without notice to you.

(c) Disclosure to Law Enforcement We reserve the right to release current or past personal information: (i) in the event that we believe that the Services are being or have been used to commit unlawful acts; or (ii) if the information is subpoenaed or requested pursuant to any court order or lawful request by public authorities, including to meet national security or law enforcement requirements; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena/court order, prior to disclosure of any personal information pursuant to a subpoena.

(f) On the Basis of Consent. Where you provide consent, we share your information as described at the time of consent, such as when authorizing a third-party application or website to access your Ensemble Schools account or participating in promotional activities by Ensemble Schools or third parties.

(g) Marketing. As explained in the Marketing Information section above, we also may share your information, including your Personal Information, with our affiliates and other third parties, such as companies with whom we have marketing or other relationships, for direct marketing purposes. In addition, we may share the information we have collected about you, including Personal Information, as disclosed at the time you provide your information and as described in this Privacy Policy.

(h) For Internal Business Processes and Promotion. Where permissible under applicable law, we may use certain information about you, such as your email address, de-identify it, and share it with social media platforms, to generate leads, drive traffic to Ensemble Schools, or otherwise promote our products and services.

(i) To the Other Users of the Services. We may share information about you, such as your username, and other information that will help others understand your connections with others using our services. Your account privacy settings may allow you to limit the other users who can see the personal information in your user profile and/or what information in your user profile is visible to others. Please remember that any content you upload to your public user profile, along with any personal information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in forums, messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. Your username may also be displayed to other users if you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments.

Integrating Social Networking Services

One of our unique features allows you to enable or log in to the Services via various social networking services like Facebook, Google, X, You Tube or LinkedIn (“Social Networking Service(s)”). By directly integrating these services, we make your online experiences richer and more personalized. To take advantage of this feature, we will ask you to log into or grant us permission via the relevant Social Networking Service. When you add a Social Networking Services account to the Services or log into the Services using your Social Networking Services account, we will collect relevant information necessary to enable the Service to access that Social Networking Service and your data contained within that Social Networking Service. As part of such integration, the Social Networking Service will provide us with access to certain information that you have provided to the Social Networking Service, and we will use, store and disclose such information in accordance with this Privacy Policy.

You may also have the option of posting your activities to Social Networking Services when you access content through the Website (for example, you may post to Facebook that you performed an activity on the Website); you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any Social Networking Services you have enabled will be able to view such activity. Because we use social media plugins, if you visit our Site while logged in to a social networking account, personally identifiable information about your browsing activities on this Site may be transferred to the third party who operates that account. Aggregated information

We may aggregate, de-identify, and/or anonymize any information collected through the Website or Services such that such information is no longer linked to your personally identifiable information. We may use and share this aggregated and anonymized information (non-Personal Information) for any purpose, including without limitation, for research and marketing purposes and may also share such data with our affiliates and third parties, including advertisers, promotional partners and others.

Your Rights and Choices About the Personal Information We Collect

You may choose to restrict the collection or use of your Personal Information In the following ways:

  • Whenever you are asked to fill in a form on our website or our other Services, consider what information to include and exclude.
  • We may provide you with access to your registration information and the ability to edit this information in your account settings dashboard and profile pages. Please be aware that even after you delete or update information within our Services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems. Similarly, if and to the extent any information is indexable by search engines (including, without limitation, public profile information), it may not be updated by such search engines when we update it, and old versions may be archived by them or by third parties outside our control.
  • Some of our Services may provide you with additional information and choices about your privacy, which you should review.

Retention of Personal Information

We retain Personal Information that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as is required in order to contact you about our Services, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements).

We regularly review collected data and set data retention policies in order to delete data in accordance with contractual agreements, legal obligations and applicable data protection laws.

Children’s Privacy

Protecting children’s privacy is important to us. For that reason, no part of our Site is targeted to attract anyone under the age of 13. However, we may collect information of children under the age of 13 when their parent or guardian provides it to us for a particular purpose. For example, you may be able to add to their contact list a minor under 13 years of age that may include their personal information such as an address, school, preferences, allergies, size, and date of birth. However, we do not solicit this information from the child directly.

If you believe we have information regarding a child under the age of 16 that you have not authorized, you may contact us at the contact information at the end of this Privacy Policy to request that we delete it.

Visitors to the Website Outside of the United States

If you are visiting the Website from a location outside of the U.S., your connection will be through and to servers located in the U.S. Information you receive from the Website will be created on servers located in the U.S., and information you provide will be maintained on web servers and systems located within the U.S. The data protection laws in the United States may differ from those of the country in which you are located, and your information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. Updating Personal Information

We prefer to keep your Personal Information accurate and up to date. If you would like to change your contact information, please contact us as set forth above.

If so, we will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable (but we may retain prior information as business records). Please note that it is not always possible to completely remove or delete all your information from our databases and that residual data may remain on backup media or for other reasons, such as a legitimate business reason.

In addition, please note that if you implement a deletion request but later sign up for information or Services, your most recent request will control our information relationship with you.

For your convenience, the Website(s) and this Privacy Policy may contain links to other websites. Ensemble Schools is not responsible for the privacy practices including their use of AI, advertising, products, services, or the content of such other websites. None of the links on the Website(s) should be deemed to imply that Ensemble Schools endorses or has any affiliation with the links.

Security

We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, mobile networks, wireless transmission, or electronic storage of information can be guaranteed 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from our Website, and you provide us with your information at your own risk.

California Privacy Rights

Under the Shine the Light law, California residents may request certain information regarding Ensemble Schools’s disclosures in the prior calendar year, if any, of their Personal Data to third parties for their own direct marketing purposes. If you are a California resident, you can make such a request by contacting us at legal@ensembleschools.com. You must clearly state the nature of your California Privacy Rights request and provide sufficient information for us to process your request; at a minimum your name, email address, and California postal address. We will respond to your request within 30 days.

Nevada Privacy Rights

If you are a Nevada resident, you have the right to request certain information from us regarding the collection and sale of your personal information (as defined in Nevada Revised Statutes 603A.320) during your visit to our websites or when you otherwise interact with us online. If you have sought or acquired, by purchase or lease, any goods or services for personal, family, or household purposes from the Ensemble Schools Website, you may ask us to disclose whether we have sold (for monetary consideration) certain information about you (including your first and last name, physical address, email address, telephone number, an identifier that allows you to be contacted either physically or online, or other contact information that allows us to identify you personally).

As a Nevada resident, you may also request to opt out of us sharing such information about you. To make this inquiry, please submit a request by contacting us at legal@ensembleschools.com. You must include your full name, email address, and attest that you are a Nevada resident by providing a Nevada postal address in your request. Please state whether you are requesting information and/or opting out.

We will process your request within 60 days, or we will let you know if we need additional time. We may require additional information to verify your identity before we can respond.

Global Privacy Control

At this time, we do not recognize and honor Global Privacy Control (“GPC”) for U.S.- based users; if GPC is enabled, we would recognize this as an “opt out of the sale or sharing of personal information” or as an “opt out of targeted advertising and the sale of personal data” request (non-California U.S. residents).

Do Not Track

Do Not Track (“DNT”) is a web browser setting that requests that a web application disable its tracking of an individual user. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and other web services you encounter while browsing to stop tracking your activity. Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party websites or online services (e.g., browser do not track signals), but there is no universally-agreed upon standard for what a company should do when it detects a DNT signal. Currently, we do not monitor or take any action with respect to these signals or other mechanisms.

Because Ensemble Schools works with global companies and technologies, we may transfer your Personal Information outside of the country in which it was originally provided. This may include transfers to third parties, such as developers, service providers or affiliated entities who are location outside the United States, Canada or the European Union or the United Kingdom, where data protection laws may not offer the same level of protection as those in the U.S., E.U. or European Economic Area. When we transfer personal data outside of these areas, we take steps to make sure that appropriate safeguards are in place to protect your Personal Information.

Changes to our Privacy Policy

We may elect to change or amend our Privacy Policy; in such event, we will post the policy changes in our Privacy Policy on the Website and send you an email at legal@ensembleschools.com indicating that the terms have changed. GENERAL STATEMENT FOR US RESIDENTS

Residents of certain states in the United States may have additional rights in the future and Ensemble Schools will update this policy as and when such laws become applicable to us.

This Supplemental Policy describes Ensemble Schools’s practices regarding the collection, use, and disclosure of Personal Information and provides instructions for submitting data subject requests.

This Notice does not apply to personal information that we process as a service provider on behalf of our customers.

Your Rights to Your Personal Information

Generally, the rights available to residents of the United States under various privacy laws can be categorized as follows:

Processing of Sensitive Information:

Ensemble Schools will not discriminate against customers who exercise their rights under state privacy laws.

Personal Information of Minors

Our Services are not intended for children or minors under the age of 16. Accordingly, we do not knowingly store information from minors under the age of 16 except as required pursuant to applicable law.

Financial Incentives for Consumers

We do not have any programs which provide financial incentives for consumers.

Exercising Access, Data Portability, and Deletion Rights

To exercise any of these rights, you can submit your request by contacting us at legal@ensembleschools.com. We will respond to your privacy requests within 30 days’ and notify you of the action(s) we have taken or required steps to fulfill the request.

Only you or a person registered with the appropriate state authority that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
